Terms of Service

1.Who these terms are between

These Terms of Service ("Terms") are an agreement between you and the individual who operates this website at mahdidanadel.com, publishing under the name Mahdi Danadel ("the Site," "I," "me"). By using the Site or purchasing anything through it, you agree to these Terms. If you do not agree, do not use the Site.

2.The products

The Site sells digital educational products, meaning ebooks delivered as PDF downloads and flashcard decks with audio (together, the "Digital Products"). Product pages state what is included; what is described is what you get.

Live 1:1 coaching sessions are not currently offered. If and when they are, the coaching terms in Section 8 apply.

3.Purchases and payment

Digital Products are sold through Fourthwall, a third-party commerce platform acting as merchant of record. Your purchase is also subject to that platform's own terms at the point of sale. I never see or store your card number. Prices are in U.S. dollars and may change at any time; a price change does not affect a purchase you have already completed.

4.Refunds

Digital Products: all sales are final. The full Refund Policy is part of these Terms.

5.Your license to the Digital Products

Buying a Digital Product gives you a personal, non-exclusive, non-transferable license to download, keep, read, and use it for your own learning. You may keep copies on your own devices and make personal backups.

You may not:

• share, publish, upload, or otherwise distribute a Digital Product or any substantial part of it, free or paid;
• resell, sublicense, rent, or bundle it into another product or service;
• remove attribution or pass the material off as your own;
• use the Digital Products to train, fine-tune, or ground a machine-learning model or dataset without written permission.

If a license is abused, I may revoke it and pursue remedies available under copyright law.

6.Intellectual property

The Digital Products, the Site, and all their content (text, design, graphics, audio, files) are my property and are protected by copyright and other intellectual-property laws. All rights not expressly granted are reserved.

7.Education only. No guaranteed outcomes.

Everything on the Site and in the Digital Products is general language education. Learning outcomes depend on your own effort, consistency, and starting point, and nothing here guarantees fluency, proficiency, or any specific result or timeline. The materials are not accredited or certified language instruction, and are not a substitute for a formal course, certification program, or official language proficiency exam where one is required.

8.Coaching sessions

This section applies only if and when live 1:1 coaching is offered through the Site. Coaching would be booked for a specific date and time, and would be informal 1:1 instruction rather than accredited teaching. Cancellation and rescheduling terms, and the booking and payment platform used, will be stated on the booking page at the time of purchase and in the Refund Policy. I reserve the right to reschedule a session I cannot make, in which case a replacement time or a refund will be offered.

9.Free materials and email

Free materials offered in exchange for an email address are for your personal use under the same license as Section 5. Email subscriptions are governed by the Privacy Policy; you can unsubscribe at any time using the link in any email.

10.Acceptable use of the Site

Do not attempt to break, probe, overload, or gain unauthorized access to the Site or its infrastructure; do not scrape the Digital Products; do not use the Site for anything unlawful.

11.Referral and affiliate links

Some pages or content may contain referral or affiliate links to third-party products, for example other language-learning tools or apps. If you make a purchase through one, I may earn a commission. It never costs you anything extra, and a product is never recommended because it carries a referral link.

12.Disclaimer of warranties

The Site and Digital Products are provided "as is" and "as available." To the fullest extent permitted by law, I disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. I do not warrant the Site will be uninterrupted or error-free, or that the Digital Products are free of inaccuracies.

13.Limitation of liability

To the fullest extent permitted by law: (a) I am not liable for indirect, incidental, special, or consequential damages arising from the Site or the Digital Products, even if advised of the possibility; (b) for anything provided free of charge, my total liability is zero; and (c) for anything you purchased, my total liability for all claims combined is limited to the amount you paid for that item. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; where that is the case, liability is limited to the smallest amount the law allows.

14.Indemnity

You agree to indemnify and hold me harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or Digital Products.

15.Changes to the Site, products, and Terms

I may update the Site, the products, and these Terms over time. The "Last updated" date above reflects the current version. Material changes apply going forward from posting; continued use after a change is acceptance of it.

16.Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws rules. Before bringing a formal claim, you agree to first contact me through the contact page and give me 30 days to resolve the issue informally.

17.Miscellaneous

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and me regarding the Site. Failure to enforce a provision is not a waiver of it.
